His speech would be fine if he wasn't doing it as an officer. For example, nobody would care if he was mouthing off in a bar off-duty. When he makes press conferences in uniform, then it's a problem. Prosecuted? Probably not, more like administrative punishment (aka paperwork or no promotions in rank).

I still see it as signing away his rights, but its nice to know the context, and I can see how people would disagree.

What right are you seeing he signed away? Any business you worked for would do the same if you wore a polo shirt emblazoned with their logo, held a press conference and then badmouthed the board.

When he came dressed as an officer, he was no longer speaking for himself, but for the organisation he represented. If I pretended to be you and spoke a bunch of lies, then you would be just as pissed as the organisation is at this guy.

Aside from Deacon's point, they DON'T call it a crime. They call it a violation of the Uniform Code of Military Justice. This is an action that has results SIMILAR to some crimes (court proceedings, restriction of liberty) but it isn't actually a civil crime.
